1. The Privacy Policy.
The following Privacy Policy applies to your use of Vphonet Services (as defined below). The Vphonet improves your online experience by offers you access to a variety of features, offerings and content. By registering to Vphonet you gain access to Vphonet's services, which consists of various services provided by Vphonet such as Vphonet free (PC-PC) VoIP calls, SMS message, file transfer, an answering machine, chat, video calls, video messages and more, the Vphonet website, My account and all related servers, directories, listings, message boards, tools, information and databases (collectively the "Vphonet Services" or "Services"). Your ongoing use of Vphonet's services signifies your consent to the information practices disclosed in this Privacy Policy. If you object to any provision of this Privacy Policy please do not proceed with registration and please do not use Vphonet's services.

 

When you register with and/or use Vphonet's services, you may provide Vphonet with, or Vphonet may otherwise obtain, personally identifiable information. This Privacy Policy explains the information practices that apply to your Vphonet services information. This Privacy Policy applies only to information Vphonet collects about you as a user of Vphonet's services. This policy does not apply to information about you collected by third party Web sites and offerings linked to or otherwise accessible from Vphonet's services. The information collected or obtained by these third parties is subject to their own privacy policies. Additionally, in the event you access a service using Vphonet's services which is co-branded with a third party, the third party's privacy policy, in addition to Vphonet Privacy Policy, may also apply.

 

2. Collection of your Vphonet Personal Data
Your Vphonet Personal Data consists of personally identifiable information provided by you or otherwise collected or obtained by Vphonet when you interact with the Vphonet's services. Depending on how you use the Vphonet's services, Vphonet Personal Data may include:
  • Registration-related information (such as first name, middle name, last name, home addresses, e-mail addresses, telephone and/or fax numbers, birth date or gender);
  • Information made available by you in Vphonet 'public areas' (as defined below);
  • Information about the searches you perform through Vphonet's services and how you use the results of those searches;
  • Information about Vphonet's services or offers that you use, including, without limitation, how frequently you use them and other related information regarding your usage of Vphonet's services;
  • Information about use of features and buttons on the software (as defined below) to determine which software features and buttons are most popular and useful to users;
  • Transaction-related information (such as credit card or other preferred means of payment, billing or shipping information, or a history of products purchased through the Vphonet's services);
  • Customer service information about you as a Vphonet's services user or subscriber;
  • Other information specifically related to your use of a particular one of Vphonet's services
  • Certain technical information gathered or received when you use Vphonet's services. Some of the technical information that may be collected or received includes:
  • The type of browser you are using (e.g., Netscape, Mozilla, Internet Explorer);
  • The type of operating system you are using (e.g., Windows XP), CPU type (e.g. Pentium);
  • Your manner of connecting to the Internet (e.g., connection speed through narrowband or broadband access);
  • Internet protocol (IP) address; information about the version of service from Vphonet that you used prior to registering with the Network;
  • Other information about your geographic location, and the domain name of your Internet service provider.
Your Vphonet personal data may be supplemented with additional information from other companies. In addition, many software versions provided by Vphonet ('software') are configured to automatically report back information relating to computer errors arising in connection with use of the software, without notice to you. Information on your software configuration settings may be included. This data is sent to Vphonet's development department to help us diagnose performance issues with the software and improve it.

 

3. How Your Vphonet personal data is used
    Your Vphonet personal data is used to:
  • Operate and improve the software, Web sites, services and offerings available through Vphonet's services;
  • Provided you with personalized content and advertisements;
  • Fulfill your requests for products, programs, and services:
  • The company asks for subscriber information in order to verify your identity and to provide to bill you for VoIP Service and we will, therefore, provide this billing provider with the necessary billing data.
    Please note that your billing data is sensitive information, which can be used to find out information about your use of VoIP Service. Please be sure to keep this information safe and do not share it with others.
  • The company may share your information with its affiliates. In order to provide you with with VoIP Services or any other services you request, the company may sometimes, if necessary, share your personal and traffic data with carriers, partner service providers and/or agents, for example the PSTN-VoIP gateway provider, distributor of Vphonet software VoIP Service and/or the third party banking organization or other providers of payment services. The company will always require these third parties to take appropriate organizational and technical measures to protect your personal data and traffic data and to observe the relevant legislation. Please be informed that, notwithstanding the abovementioned, in the event of a designated competent authority requesting Vphonet or company’s local partner responsible towards such authority, to retain and provide personal and/or traffic data, or to install wiretapping equipment in order to intercept communications, company and/or its local partner will provide all necessary assistance and information to fulfill this request.
  • Communicate with you and respond to your inquiries;
  • Conduct research about your use of Vphonet's services;
  • Help offer to you other products, programs, or services that may be of interest to you.
  • Invite your friends to join Vphonet. In the event you wish to use Vphonet's referral service, you will be directed to a webpage and will have the possibility of adding one or more e-mail addresses in an online form. The information entered in this form, will only be used for the purposes of automatically generating an e-mail message to these potential Vphonet users.

Your Vphonet personal data will not be shared with third parties unless:
  • You have published such information in 'public areas' (as defined below);
  • We have your prior consent to disclose such information;
  • We need to disclose such information to fulfill a transaction you have requested;
  • We are required to disclose such information to authorized officers of the court in order to comply with valid legal process or to act in other urgent circumstances (as further specified below);
  • We need to send such information to a company which works on behalf of LANS HK in helping us provide our services to you. In such circumstances we will only provide these companies with the information they need to deliver the service and they will only be permitted to use such data on our request and in accordance with our instructions.
The contents of your online communications, as well as other information about you as a Vphonet's services user (e.g. IP address), may be disclosed (i) to authorized officers of the court in response to legal process (for example, a court order, search warrant or subpoena) or in other circumstances in which we believe Vphonet's services is being used in the commission of a crime or when we have a good faith belief that there is an emergency that poses a threat to the safety of you or another person; or (ii) when necessary either to protect the rights or property of LANS HK, Vphonet or its affiliated providers, or for us to render the service you have requested. The company may use agents and contractors in order to help operate Vphonet's services. If such agents and contractors have access to personally identifiable information, they are required to protect this information in a manner that is consistent with this Privacy Policy Vphonet Services. You should also note that Vphonet's operational personnel may be occasionally exposed to random usage traffic going through the Vphonet servers.
In the event that ownership of Vphonet's services was to change as a result of a merger, acquisition or transfer to another company, your Vphonet Services information may be transferred.
Vphonet will retain your information for as long as is necessary to: (1) perform the VoIP Service; (2) invoice you for use of the VoIP Service, and to maintain records until invoicing for the VoIP Service cannot be lawfully challenged and legal proceedings may no longer be pursued; (3) carry out Vphonet marketing activities; (4) comply with applicable legislation, regulatory requests and relevant orders from competent courts; (5) enforce our Terms of Service; or (6) fulfill any of the other purposes detailed in this Privacy Policy.

 

4. Direct Marketing
During registration for Vphonet's services (software) and at other times while using Vphonet's services, you may be asked if you would like to receive various promotional offers from Vphonet. Upon your consent, Vphonet may use your Vphonet personal data to send email, SMS, or any other electronic communications (including, without limitation, any electronic means available through the software) ('direct marketing') to you about certain promotions on behalf of selected third parties.

Direct Marketing does not apply to communications and information sent by Vphonet (whether by email, through the Software, or other means) that is directly related to your registration with Vphonet's services and the various features (including notifications of new features) contained within Vphonet's services, or the fulfillment of a specific transaction you have requested (for example, a service advisory from Vphonet's services, or an acknowledgment of a purchase order). Please note if you have chosen to use a version of the software co-branded with a third party, direct marketing shall not apply to communications and information sent by such third party through the software that is directly related to your registration with the third party's services and the various features (including notifications of new features) provided to you by such third party, or the fulfillment of a specific transaction you have requested (for example, an acknowledgment of a purchase order). In addition, direct marketing does not apply to advertisements provided to you through Vphonet's services, including from Vphonet business partners. These business partners and advertisers receive aggregate data about groups of users, but do not receive information that personally identifies you, except if otherwise agreed by you.

 

5. Public Areas and my details
If you use Vphonet's services to disclose information about yourself publicly, for example, in or through: user search, groups, lists, blogs, Vphonet directories, your 'My information' (as defined below) or any other area reasonably understood to be a public area (collectively, the "Public Areas"), other online users may obtain access to and use any such information you provide. You should therefore carefully consider whether you wish such information to be accessible by others. You should also note that others may be able to record certain information even if not made available in a Public Area, such as the content at a session or your IP address. The IP address is an integral part of the TCP/IP standard protocol of the Internet and can be extracted by any party, and transferred to the communication session using certain software and/or hardware.
The 'My information' on website users are able create a personal profile for themselves by providing various details about themselves. Users provide personal details during registration and any time thereafter through the software or the Vphonet Websites (My account). You may be required to provide a username and password that will be used as your Vphonet identifier. Vphonet does not require you to input any other personally identifiable information about yourself.
The Vphonet user has the ability and discretion to edit provided details on Vphonet website (My account). For this reason and other reasons it is very important to keep your password in a safe place. It is your responsibility to keep your password and username secure.

 

6. Our Commitment to Security
Vphonet has established safeguards to help prevent unauthorized access to or misuse of your Vphonet Personal Data, but cannot guarantee that your personally identifiable information will never be disclosed in a manner inconsistent with this Privacy Policy (for example, as a result of unauthorized acts by third parties that violate applicable law or of Vphonet's policies and its affiliated providers).

 

7. General Internet Hazards
You should be aware that receiving files from third parties via any application (e.g. Vphonet, email, etc.) may be harmful. Before receiving any files from any user, and even if the account from which the file transfer notice is sent looks familiar to you, it is strongly recommended that you verify that the person sending you these files is indeed the person you think he is, for example by asking him for some kind of information known only to the two of you. Please make sure you do not receive files from users you do not trust, from users you are not sure they are whom they say they are or whenever you are not sure you want to receive the files.
Cookies
Vphonet's services may use cookies or similar technologies in combination with your Vphonet Services information to enhance and personalize your experience of Vphonet's services, including, without limitation, to operate and improve offers through Vphonet's services; to help your genuine authentification when you use Vphonet's services; to remember your preferences and registration information; to enable a shopping cart; to present and help measure and research the effectiveness of Vphonet's services offers, advertisements, and e-mail communications (by determining which Network e-mails you open and act upon); and to customize the content and advertisements provided to you through Vphonet's services.
A cookie is a small text file transferred from Vphonet to your computer that records information about your preferences and use of services provided by Vphonet. Such cookies may also include cookies which help Vphonet to identify your location (ie. by determining your IP address) while others may assist Vphonet in remembering certain settings that you have chosen.

 

8. European Union Members - International Transfer of Data
Vphonet's services are of international scope. By using Vphonet's services, you consent to your Vphonet personal data being sent to and processed in other jurisdictions, including the United States and other jurisdictions outside the European Union and European Economic Area where there may be less stringent data protection laws.

 

9. Refund policy
The refund policy refers to services purchased from the Vphonet.com website. Accessories sold by third parties to enhance your computer for VoIP such as headsets and speakerphones are covered by the terms and conditions of the relevant site or service. This includes third party sites linked from the Vphonet site.
In general, virtual goods, such as 'Calling Out', 'My SMS', 'Answering machine', 'Change Vphonet No' services are all non-refundable. To ensure you are satisfied with any product you purchase from our service, you should extensively test your Vphonet free services first. However, to allow you to test the 'Calling Out' service, we will refund your purchase if you have used less than $0.50 USD of your purchased credits, up to (10) days from the date your credits are assigned to your account.
When 10 days have elapse, or you have used more than $0.50 USD of your credit, we will not refund the purchased services. Requests for refunds should be made from the support site, where you can submit a message to request a refund. Processing refunds on 'Calling Out' credit can take up to 30 business days. You will receive an email notification when your credit is successfully processed. 'Calling Out', 'MySMS', 'Answering machine' service and all Vphonet Plans expires 12 months after purchase. However, the service purchase fee is non-refundable.
We do not make refunds on individual calls, where you might experience issues. All services are non-refundable.

 

10. Making Purchased
    The Vphonet users can purchase our services by choosing secure payment services:
  • Moneybooker
    Vphonet accepts payments from users with Moneybooker accounts. Moneybookers Ltd. is a licensee of the TRUSTe Privacy Program. All personal details and all money transactions are secured using Secure Socket Layer (SSL) technology with high security 128bit encryption, certified by Thawte. To open your Moneybookers account, the user must obtain certain personal information, such as name, address, email or phone number as well as demographic information like age. For certain optional transactions, Moneybooker also collects selected financial information such as credit/debit card details.

    11. Special Note for Parents
    Vphonet's services are intended for a general audience, but children under the age of thirteen are not permitted to register with Vphonet. If it comes to Vphonet's attention through reliable means that a user of Vphonet's services is under the age of 13 then Vphonet may delete such users account.

You may be provided other privacy-related information in connection with your use of offers from Vphonet's services, as well as for special features and services not described in this Privacy Policy that may be introduced in the future. This Privacy Policy took effect on January 1, 2008.
